Finding the right home to meet your needs is half the battle in
the world of buying a home, and there are several things you can
do to ensure you get the ideal home.
First, be sure you're working with a buyer's agent - someone who
will work only for you as the home buyer. A buyer's agent has
fiduciary duties to the buyer which include reasonable care,
undivided loyalty, confidentiality and full disclosure. It's
important to note, though, in dealing with sellers, a buyer's
agent must act honestly. In dealing with both parties, a buyer's
agent may not make any misrepresentations on matters material to
the transaction, such as the buyer's financial ability to pay,
and he or she must disclose defects of a material nature
affecting the physical condition of the property which a
inspection by the licensee would disclose.
Once you've located the right buyer's agent, he or she may ask
you to obtain pre-approval from a mortgage company. Pre-approval
helps to signify to potential sellers that you are serious about
your offer on their home.
As you search the listings for the ideal home, be sure you stay
in touch with your agent. Be prepared to view a home as soon as
it is listed, and don't hesitate to scout the listings yourself
online or in the paper.
Keep in mind that the moment to make your decision could come at
any second, and vacillating may mean another buyer has the
opportunity to purchase before you do. At the same time, though,
do your research before you make an offer. Ask your agent for
the seller's disclosure form, and carefully evaluate any known
material defects. You'll still need to hire a home inspector as
you get closer to closing the deal, but the disclosure form is a
good place to start.
